"The Nipple Law:" Societal Hypocrisy or 4th Amendment Rights Violation?
As the Georgia summer heats up, men everywhere are peeling off their shirts in an effort to cool down exposing chest hair and nipples in full public viewing! Obscene? Our culture says NO! If a female were to do the same as the scorching Georgia heat index affects our comfort zone also, we would be facing criminal charges of lewd and lascivious behavior and indecent exposure! Why the double standard? Societal Hypocrisy or a 4th Amendment Constitutional Rights Violation? A nipple is a nipple! Granted, the female nipple is slightly larger, more protruding in presentation and generally attached to a developed breast, but in the end… still just a nipple. The fact that males are allowed to publicly expose both their chest and nipples in plain view as a traditionally accepted societal norm, whereas the females of our culture will face legal consequences including possible arrest, fines and incarceration for performing the exact public act as afforded to the males of our culture is indeed societal hypocrisy; but further, it most certainly is a violation of our constitutional rights under the 4th Amendment providing United States citizens equal protection under the law.
Curiously, most strip clubs promoting exotic dancers require "pasties" or decorative coverings for the female nipple as part of the dress code for all performers. The result is compliance with the "Nipple Law" while allowing complete exposure of the female breast for the entertainment and enjoyment of the club’s patrons, which ironically are most abundantly male in persuasion. These dress codes enacted in community strip clubs are the direct result of enacted city ordinances preventing nude female dancing. Laughable! Exotic dancers are most certainly nude as they dance with a mere string and decorative "pasties" completing their entire occupational costume! Conversely, male strip clubs have no such "pasties" requisite. Male exotic dancers freely expose their chest and nipples like proud peacocks! Societal Hypocrisy or 4th Amendment Rights Violation?
Likewise, modern female clothing designers are acutely aware of the "Nipple Law!" However, there seems to be no "cleavage law" in existence considering the modern female clothing apparel routinely accepted as our society progresses from the "dark ages." Routinely, shirts and dresses are designed to plunge deep into the female chest area, maximizing the public’s viewing of the breast cleavage without actually exposing the tabooed nipple. A glimpse of any Hollywood awards ceremony will bring my point to clear focus as the cameras zoom in to capture every nook and cranny possible our favorite Stars may reveal! Men routinely discard shirts entirely in the summer months as "useless" in their efforts to achieve maximum comfort in the scorching heat. View any beach in America and you will find "The Nipple Law" in full force! Traditionally, men wear trunks or Speedos and bare chests while women are afforded a choice of a two piece bikini or one piece which accomplishes full legal coverage in an effort to comply with "The Nipple Law." Any female assuming "equal rights" with men who choose to go boldly into public view topless unto the grains of the same sand are met with immediate confrontation by the appropriate authority figure on scene to remedy the offense. Societal Hypocrisy or a 4th Amendment rights violation?
When did society judge the female nipple X-rated and obscene public viewing mandating the offensive appendage appropriately hidden and the male nipple G-rated public viewing acceptable for all audiences? Recently, a breast feeding mother was removed from an airline flight for allegedly exposing her nipple during feeding. Traditionally, societal members expect mothers to cover their breast and infant during the feeding process, obviously disregarding the infants need for fresh air evidently in an effort to prevent public viewing of the natural act. The response was immediate! A breast feeding sit-in reminiscent of a civil rights civil disobedience rally was organized and conducted in all major airport terminals! Why was no one arrested for nipple exposure?
Horrified were millions of television viewers as the infamous Janet Jackson and Justin Timberlake costume "mishap" during the Super bowl halftime event exposed the entertainer’s nipple for all to see. Again, no arrests were made; but immediate measures were implemented to prevent the female nipple to be viewed on prime time television in the future. The solution? A five second delay in live broadcasts giving censors a window to delete any future attempts to violate "The Nipple Law!" We all are aware of the "copycat criminals" who would indeed attempt the same antics in a futile effort to draw attention to themselves! Had Janet had the foresight to wear "pasties" maybe the national outrage would have been a mere rumble instead of a roar! I doubt it though!
Maybe it is time to review, even question or repeal "The Nipple Law" in effect for females only? If not, I fully expect to see those hot, sweat construction workers working within public view to start wearing their "pasties." Status Quo has got to Go!

Whew, tell us how you really feel. Anyway, I think that you're right. It is not the government's job to tell us what we should or should not wear. The way that we choose to dress is clearly a form of expression. The government has always been wrongly obsessed with morality rather than justice and freedom. So I say LET THOSE PUPPIES BREATHE! ;O)

I was raised in Europe so I was not brainwashed with repressed sexual expression. I feel the American culture in particular is plain "prudish" about the human body. It is an absolutely beautiful creation and should not be hidden by governmental mandates placating the obvious religious agenda enforcing America's morality codes. As a libertarian, I believe in freedoms and choices. I certainly would choose to peel off my shirt in the summer months down here just as the men folk do and never give it a second thought! But obviously the law enforcement would take notice and who needs a conviction for indecent exposure on their record? Sounds like a homeless pervert when a potential employer does a background check! The European culture freely accepts nudity in full public view without judgement of the individual, why does America seem to reside in the "dark ages?"

You referred to the 4th Amendment in this blog and perhaps you meant the 14th. The 4th deals with search and seizure laws that I think would be irrelevant with no shirt to search. The 14th, however, deals with equal protection under the law.

Thank You for the correction. Indeed I was referring to the 14th which grants equal protection under the law. Again, thank you for bringing this to my attention as I was preoccupied obeying the nipple law!!
