Let's Talk About Public Nuisance And Your Rights

What are some of the nuisances in your life? Do you feel that annoyances, nuisances can be identified as bullying, as someone trying to control you and your wellbeing and attempting to use you as an example for others to stay in line or else they shall share the same faith?

In very general terms, a nuisance is something that annoys - a wearing on the nerves by a persistent unpleasantness. It can evoke anger and interfere with comfort and peace of mind. A nuisance as a legal term is a condition or use of a property that interferes with neighbors' use or enjoyment of their property, endangers life, health or safety, or is offensive to others.

You, as a victim of such bullying, can after exhausting all venues of some relief, and short of pursuing legal action through civil court and request relief from such actions against the bully may want to consider first going to the court of public opinion on the matter. However, is it wise to even consider or going that route instead of you seeking legal advice about it first?

It is hoped that common sense and communication between the two parties, the bully and the victims, would prevail in such situations but what if the person doing the bullying intensifies their actions because they are a sitting city elected official, elected by you the people, and believes that as an elected official they can’t be touched. Do you coward down and let them keep bullying you or do you take a stand?

Let’s say you find out information about that sitting city elected person, who has become a public nuisance, which if put in front of court of public opinion could put that person in an awkward position as an elected official, having to answer to the citizens who elected them in office, and unfortunately bring mistrust among citizens and city government which in a way would be unfair to the rest of the elected officials of the city who have done no wrong but caught in the middle of it all. It would be like giving the sitting city elected officials a black eye of sorts and further dividing the mistrust by many citizens already of city government. We, as a people, should be sitting down and talking with each other on both sides of the isle as citizens and city government to resolve any conflict and not antagonizing citizens and bullying them.

Let’s say you have worked your way up the food chain, so to speak, by trying to communicate with the offender and come to a compromise but you find that person unapproachable. Let’s say you also have made contact to the police filing complaints against the offender and they refuse to do anything about it. Let’s say you then make contact with the city government and they say they will look into it. You are told by the city the person has broken no ordinances therefore they “cannot take action at this time”. What does at this time mean? Why would they state it that way? It almost implies they are having problems as well with that person but may feel intimated by this person. If that is the case then they need to grow a pair and do what is right for all citizens of this city or resign and give the job to someone who will work for the people of that city.

In a regulatory environment, the term "nuisance" embraces anything that results in an invasion of one's legal rights.

Shortly afterwards you find out that the source of your grievance regarding this city elected official is happening because of criminal activity by a member of that elected official’s family, which involved a vehicle owned by that elected official and now they park such vehicle along your property line instead of in their own driveway or along their property line on their street.

Let’s say that since then stupid stuff has been happening around your property because of that vehicle being parked there now for a few months. The vehicle is also impeding the flow of traffic on that street as well as the fact that the city vehicle that sweeps the streets weekly has not been able to clean along your property line because of that vehicle being there. How do you get the city to take responsibility and demand that person move their vehicle in their own driveway or along their own property line! I wonder if any of these elected officials or paid employees would stand for it if suddenly someone placed a vehicle along their property line that has been used in criminal activity. I think not! They would have had that vehicle moved instantly from their property line. Do you not think that as a tax payer in the city you live in that you expect to get the same quality service as all other citizens such as city vehicle sweeper being able to clean along your streets property line each week but isn’t because of that vehicle being parked there. Do you as the victim not have the right to feel safe in and around your own property and not have a vehicle that was used in criminal activity parked along your property line?

Let’s say you chose to instead of going to court of public opinion you decide to follow the advice of a mentor to get a lawyer whom you pay a fee to become your agent or lobbyist to get the city to do something about it. There are some in city government that are trying to get the issue resolved but pretty much come back to you and say the person is unapproachable and they need more time to try and resolve it.

Let’s say you decide to give them some more time to try and resolve this issue. How much more time would you give them? When do you make the decision to expose that elected official for what they are or file civil action suit against them for being a public nuisance? Does the city have a code of conduct for elected officials? If not, why not? It is presumed that if we as citizens elect someone into an office position who is abusing their powers of that position we should be able to demand that person be recalled and removed from office should they not!

Frankly this seems more of a personal issue that you are experiencing as opposed to putting this out there for the “Greater Good” I am in no way insinuating that you are not experiencing the situations that are causing your angst however; this is akin to a post your deleted previously to “let your legal counsel sort it out”.

It also seems akin to a veiled threat against many different entities that have failed to resolve your concerns to your satisfaction.

This statement is condescending; it implies that out of the goodness of your heart you do not want to drag the “upstanding council members” into the fray but the veiled threat still exists. They have a stake in this to and if they are not assisting you they are also part of your issue

Let me break it down for you; this Blog site does have a lot to do with social interaction and the unfettered ability to express your thoughts and observations which you have done very well. Conversely, this site is not the best place to plead your case to the entities that are harassing you. They have already shown that they are not willing to address their concerns regardless of your Blog(s), associated comments, and other avenues you have pursued. With this said, please do continue to post about whatever you want to post about. Just be cognizant that it is static that our musings or statements are open to interpretation and different views.

In my humble opinion you have a couple of choices:

Continue to work with local officials to resolve in an amicable manner

Let your legal counsel handle it and refrain from any activities they advise

Get your ducks in a row and contact your congressman

The bottom Line is whoever is the cause of your discourse does not seem too worried about the Coastal Courier Blog site. Keep Pushing, Don’t Give Up but please when you prose your comments be honest and candid that this is something you are experiencing personally and not under the guise of the greater good. Too many people in this town hold elected positions with impunity and an entitlement mentality. Nepotism, favoritism, and overt racial disparity are on display every day. HMJC Your last comment is all very true and have been told its in who you know just recently about getting things done or not still in this city. And for a price you can get things fixed if you are willing to pay it.

Funkentelecky my life does not revolve around a blog or social group on the internet. If someone has a problem or gets upset with me for not being here 24/7 responding to blogs that is none of my business and the person who feels offended can take it to the good Lord in prayer and let God direct that person.

Not that I have to defend myself because someone is upset because I may not have responded as quickly as they expect to I will let you know that my family comes first and I do have a life outside of this blog.

Yes I did post that I knew I had responded to your post but for some reason it did not show up and yes I did say that's life. I was not being disrespectful to you or anyone else. I was unable to post again for a while because of my Bells Palsy acting up. We need to quit ass-u-me(ing) something about someone.

But to give you a shorter response to what I had posted that did not show up for whatever reason I was responding to being labeled a liberal.

I am not a liberal, nor a right wing or a left wing or any other labels put on folks regarding politics.

If I must have a label I'd rather it be that of a centrist which is my being conservative on some issues and progressive on others.

I also posted as part of this where I come from that even as a toddler on to adulthood I have always believe in doing what is in the best interest of ALL AMERICANS.

I pretty much do not respond to much about one political party or another because party ideology is not how I live. I live by the constitution and love for our country.

I have made my way in this world working my butt off without help from anyone. I am of the mind set you do not get things for free and we owe no one a living. If you want something in life get off ones bum and earn it.

A good example I can relate to is AFFIRMATIVE ACTION which was available in the 70's to people of color and all females. I was offered by a college professor to go to college on affirmative action and I refused it.

I was in the Marines at the time and I went to college in late afternoons and evenings on my own dime. The Marine Corp supported my going and allowed me a couple days a week to leave work early for a college class and the rest I did in the evenings.

I completed a BS in criminology with no affirmative action or federal funding.

My point being again is that I believe we all are responsible to work for what we want in life and not have it handled to us.

Regarding political views they are pretty much moot to me for I live my life as we were trained in the Marines SEMPER FI, always faithful to the constitution and our country, and not some dump party ideology.

I am glad to have another Blogger on the site however; it seems that when a different view is presented the response is non-committal, vague, and digressing to individual accomplishments. You do not have to defend yourself but at least have the courage of your convictions. I am probably coming off as an ass which is not my intent but at the end of the day; if you start a conversation; it would seem a given that you would respond to the inquires or comments of your entire blog; not cherry picking what you want to discuss. Thicken your skin up a little bit and be an active participant in your own discussion. thanks and look forward to a more detailed response

HMJC you are mostly correct with your assessment of Hinesville and the entrenched office holders and people of authority in various positions.

However I imagine that most towns are very much like this. I've never lived anywhere else so I'm really not experienced enough to know.

This is not my first rodeo. I've fought the establishment back in the 80's and 90's with the good ole boy mentality.

I am very meticulous in doing my research and investigating things and I do make sure my "I" are dotted and my "t's" are crossed before publishing anything.

If anyone thinks they are going to bury me because they may have more money than me, or know more people or the "right" people quickly find out I do not cower down to anyone.

I'm a fighter for justice and I don't cower down to anyone.

I do not just run my mouth and make a lot of noise unless I have already investigated something.

I could dwell on the past but it is the past and moot today. A lot has changed here in the 40 years I've been here and thank the Lord for the better.

Now we have issues that have been reversed somewhat and we need to deal with those.

We need to quit talking about who did what in the past and work for now, what is happening or not happening in this area.

A lot of folks complain but won't get off their bums and do something about it.

If we feel we have a problem of any kind, we need to find a solution for it, and if it means stepping on good ole boy network or for that matter the new good boy network then so be it.

That is why as citizens we need to sit down and talk about situations that rise up and work towards a solution. If we go through channels within city government and it still isn't resolved then go further up the food chain as they say until you find someone that will come and say enough is enough.

If we don't take steps to help ourselves we will never succeed. There is no man or woman in this town or county that is above the law no matter what their status is. Sooner or later they come tumbling down and that is why we also must have patience but also keep working for change.

As far as my giving my opinion on things or events that are political in nature and the bashing of one party or another, or persons I don't play that game. I could care less as to what folks think of persons who are republicans or democrats or supposedly did this or that especially if its in the past.

We need to concentrate on what is happening today in our lives and country and sit down and start talking about solutions not being negative on stuff regarding others political choices.

As I have said a few times before I don't live or breathe a party ideology. I live to continue serving our country and defending our constitution and that is how I vote when elections come around.
