Oh wow, it's interesting you mention an Amish farmer in your article. Again, being from PA (there seems to be a trend) the Amish have never been bogged down by bureaucratic rule. There has been the occasional attempt to trounce on their 1st amendment right, but the courts usually protect them.
Still, it just goes to show (if Prohibition has taught us anything) NO LAW will ever ban peoples behavior. As long as there is a buyer, there will be a seller.
the problem with Four Loko was the perfect storm of caffeine and alcohol. the caffeine shields the body from the alcohol build up until the alcohol level is high enough to be fatal in some cases. in most cases i don't agree with the government messing with products. but when a product is targeted to college kids, and college kids are being hurt and in some cases killed by it. the government need to act to protect our kids. after all we are not there with them at their college to do it every weekend. i know they will still drink and party and such. but with most drinks the effects are noticeable before it is too late. not so with this product.

Yes, I see your concern gacpl. But unintended consequences always set in with such legislation.
According to Article 1, Section 9 of the Constitution, it's forbidden to have a writ of attainder, or bill that targets a specific group or person of guilt without a judicial trial.
So, legally they must create an over reaching law that includes Four Loko. However, other companies would need to comply even if they were not making disgusting products. Hence the “one size fits all.”
Rather, the ideal solution would be, just what you've unintentionally did; explain why this product is not a good choice.

If prohibition has taught us anything, you can never keep a product out of people's hands as long as there’s demand. Rather, much like smoking, you need to explain why it's unhealthy and leave it to the individual to weigh the cost and benefits.
I had no idea raw milk was only legal for pet food in Georgia. I have consumed raw milk most of my life since we milked our own cow for years. I have a friend that still milks his own cow and I visit him about once a week for my raw milk fix.
it's illegal to sell raw milk in most states due to the the possibility of ecoli food poisoning. before the 1980s it wasn't around. but now it is a real risk.

Oh, so you COULD get e. Coli poisioning before 1980, you just wouldnt of know the name or cause. Interesting. Well like smoking, eating hamburgers and driving a car, you need to understand the risks and choose wisely.
